In force now in Argentina
Grid access (1)
Secretariat of Energy Resolution 400/2025: rules to normalise the Wholesale Electricity Market (MEM)
Resolution 400/2025 (Boletín Oficial, 21 Oct 2025) approves the rules for normalising the wholesale electricity market, applied from 1 Nov 2025: marginal-cost price signals, contracts between generators and demand, distributors covering at least 75% of seasonal demand with contracts, new reliability reserve services and generators managing their own fuel from 2029. Large customers of distributors (GUDI, 300 kW or more of contracted power per supply point) get unrestricted access to the MEM as agents, which lets large loads such as data centers buy power directly.
300 kW GUDI threshold: contracted power per supply point
Incentive (2)
Decree 105/2026: RIGI application deadline extended to 8 July 2027 and rules changed
Decree 105/2026 (Boletín Oficial, 19 Feb 2026) extends by one year, to 8 July 2027, the deadline to apply for RIGI. It also lets technology-sector projects count a new product as an expansion of a non-adhered existing project if it needs at least USD 250 million and differs in at least 50% of its components, limits supplier benefits to capital goods, IT and telecom goods and industrial inputs, and creates a project evaluation committee.
250 USD million Minimum investment for a technology-sector product expansion; RIGI application deadline 2027-07-08
Large Investment Incentive Regime (RIGI), Law 27.742 Title VII
RIGI, created by Law 27.742 (Ley Bases, published 8 Jul 2024) and regulated by Decree 749/2024, covers eight sectors including technology, infrastructure and energy. Projects need at least USD 200 million in computable assets (40% in the first two years). Benefits: corporate income tax cut from 35% to 25%, accelerated depreciation, VAT paid with tax credit certificates, exemption from import duties on capital goods, parts and components, export duty exemption after three years, and 30 years of tax, customs, foreign exchange and regulatory stability. Data center projects can apply under the technology or infrastructure sectors.
200 USD million Minimum computable investment per project; income tax 25% instead of 35%; stability 30 years
Renewable energy (1)
Law 27.191 renewable energy targets and individual obligation for large users of 300 kW or more
Law 27.191 (published 21 Oct 2015) sets renewable targets for electricity consumption rising to 20% by 31 Dec 2025. Large users of the wholesale market and large customers of distributors with demand of 300 kW or more, such as data centers, must meet the targets individually, by own generation, private contracts (the MATER term market) or self-generation; shortfalls are penalised at the variable cost of imported-diesel generation.
20 % Renewable share of own electricity consumption required by 31 Dec 2025; applies to users of 300 kW or more
Regulation (1)
Personal data transfers abroad: Law 25.326 art. 12, adequacy list and model clauses
Law 25.326 art. 12 prohibits transfers of personal data to countries without adequate protection, with limited exceptions. Disposición 60/2016 and AAIP Resolution 34/2019 list adequate countries (EU and EEA, UK, Switzerland, Uruguay, New Zealand and others); transfers elsewhere use model contracts (Disposición 60/2016, updated clauses by AAIP Resolution 198/2023) or binding corporate rules (Resolution 159/2018). The EU renewed Argentina's adequacy in January 2024.

'Súper RIGI' bill: incentive regime for large investments in new industries, including AI data centers (file CD-6/26)
Executive bill for a second regime for very large investments in new industries, explicitly including large AI data centers. As reported, it requires at least USD 1,000 million per project, sets a 15% income tax rate, removes import duties and export duties and guarantees conditions for 30 years. The Chamber of Deputies approved it on 24 Jun 2026 (130 votes to 106); in the Senate (file CD-6/26, committees on Budget, National Economy and General Legislation) the committee report was still pending in October 2026.
1,000 USD million Minimum investment per project in the Deputies-approved text (Chequeado, 'Súper RIGI: las 3 claves'); income tax 15%

Where does this data come from?
Each action comes from a page we opened: a law, regulation, gazette notice, ministry or regulator release, grid operator notice or investment agency page, and only when official text is not available a company or trade publication. A second analyst re-opens the source before an item is published. Government sources are linked on the page; all sources come with the Excel data.
What counts as a restriction or moratorium?
A government or grid operator rule that stops, pauses, caps or conditions new data center capacity or grid connections, for a country or a region within it. Proposals are shown as proposed until they take effect.
How are power prices compared?
We use each country’s official statistics for industrial or non-household electricity, converted to US dollars per MWh at the average rate for the year where needed, and show the year and source. Contract prices for data centers can differ.
How often is it updated?
Countries are reviewed on a rolling schedule and changes are added as they are announced. Each item shows the date of the action.
Global capacity
How much data center capacity is installed worldwide?
Installed and forecast capacity in MW by region and country, 2020 to 2035, with low, base and high cases. Updated every quarter.
